These Terms of Service serve as an agreement (“Agreement”) between you (“you” or “Client”) and codemyconcept.com (“CodeMyConcept” or “we”), collectively referred to as the "Parties". This Agreement applies to this website and its services (the “Services”) and may be revised by CodeMyConcept at any time.
By browsing this website or using its services you agree to be bound by these Terms of Service and warrant that you are 16 years old or older.

1. Key Terms

1.1. Services

The Services include without limitation PSD to HTML conversion services and/or platform implementation as nominated at the time of order. The scope of agreed Services will be emailed to both Parties at the beginning of the project, after CodeMyConcept has received your completed order form and project files.

1.2. Prices

The price for the Services is nominated at the time of purchase and varies depending on the Services requested. CodeMyConcept reserves the right to amend the quote or reject orders from Client if the requested scope of work significantly exceeds the standard scope included in the price.

1.3. Payment

You agree to pay the agreed price to CodeMyConcept before we begin working on your project. Any charges payable hereunder are exclusive of any applicable taxes, tariff surcharges or other like amounts assessed by any governmental entity arising as a result of Services provision provided by CodeMyConcept to Client under this Agreement; and as such, will be payable by Client that contracts CodeMyConcept, in addition to all other charges payable hereunder.

1.4. Deposits

Upon Client’s notice, P2H may deposit any Client’s residual assets. Within one year (1 year) from the date of a deposit Client may either use such a deposit to pay the services provided by P2H to Client or claim the refund of the deposited assets. If Client fails to use a deposit or claim the refund within one year such a deposit is turned into a profit of P2H.

1.5. Delivery

CodeMyConcept will start providing Services on the first business day from the date of purchase. The completion date will be provided to Client after CodeMyConcept reviews all files and details of the project.

We aim to deliver all our projects on time. If unforeseen circumstances delay delivery times, CodeMyConcept will endeavor to offer some form of compensation up to the value of the original project cost. You are not entitled to make any further claims against CodeMyConcept beyond the original cost of the project.

Upon completion of the project CodeMyConcept shall provide the completed Services in form of a .zip file to Client. In the case you have requested some other specific form of delivery, CodeMyConcept will comply with this request if agreed by the Parties in writing.

1.6. Edits terms

After preview, if you approve the HTML5/CSS3, you are welcome to provide changes that you need to be done in order for the project to be fully pixel perfect based on your PSD files.
You will have 3 rounds of edits (for example: font styling, minor alignment changes, JS effects). If you require a change in the design that might require extra efforts, we may have to charge an additional fee.

A round can be defined as a list of edits that we are going to complete.
Once the first round is fully completed, if few more changes are required you will be able to send a second round and a third round if needed. After the 3 rounds of edits are finalized you can ask for more changes, but this will be charged separately.

We will need a detailed list of changes (screenshots if possible) in order to provide a fast and efficient result. Failure to provide this may result in a delay in completion time, and CodeMyConcept cannot be held responsible as a result.

Please not that edits on the CMS have the same flow as the HTML process, but they are only related to functionality (for example: change widgets, use a different plugins, the logic of the code) and not HTML5/CSS3 because we will be using the HTML code that you previously approved.

1.7. Refund terms

A full refund will be considered in the following situations:
a) Client’s order cannot be completed as requested;
b) Client’s request to cancel the order is received before development work is started.
A partial refund will be considered in the following situations:
a) Client is not satisfied with the quality of the code or Services and provides a reasonable, legitimate, and comprehensive explanation of the matter;
b) Client is not satisfied with the product after reviewing it on CodeMyConcept test server. In such cases, a partial refund may be issued upon the agreement about the details related to the refund.

If the order is completed according to the specifications of Client, some minor errors are inevitable and are not justification for full or partial refund.

2. General Terms

2.1. Intellectual Property Rights

In respect of the material, information or files specifically created for Client as part of the Services, CodeMyConcept agrees that all of the copyright, other intellectual property rights and any other data or material used or subsisting in the project files, whether finished or unfinished, belong to Client after Client has fulfilled all his obligations towards CodeMyConcept.

2.2. Warranty

CodeMyConcept represents and warrants that:
  • The Services will be provided with reasonable care and skills; and
  • The Services and files provided by CodeMyConcept to you will be free from any viruses, worms and disabling programming codes.

2.3. Recording of conversations

We inform you that any conversation you have with us may be monitored and recorded for quality assurance purposes. If you do not wish to have a conversation recorded you must alert to cease recording the conversation. Your continued participation in a conversation without expressly requesting for the conversation not to be recorded shall serve as your express consent to have the conversation monitored and recorded.
